TERMS & CONDITIONS

 

1. Relationship and scope

This arrangement explains how the Merchant Outlet and Airpartystay Private Limited will work together for property visibility, guest inquiry generation, and booking support.

Airpartystay may publish and promote the Merchant Outlet across its website, digital channels, and marketing initiatives in order to improve discoverability and help attract prospective customers.

 

Listing

Property details may be displayed on Airpartystay-owned channels and related promotional placements.

Promotion

Campaigns may include organic, paid, social, and marketplace-oriented marketing activity.

​

Support

Airpartystay may assist in lead handling and booking coordination where operationally required.

 

2. Merchant obligations

The Merchant Outlet is responsible for ensuring that all property information supplied to Airpartystay remains correct, current, and complete at all times.

• Provide accurate descriptions, amenities, pricing details, and availability information.

• Share high-quality photographs, videos, and supporting material suitable for digital publication.

• Maintain guest experience standards, including cleanliness, hygiene, safety, and service quality.

• Ensure that the property shown in listings reflects the actual on-ground condition without misleading representation.

• Confirm that no undisclosed fees or hidden charges are imposed on customers.

Quality safeguard: Airpartystay may pause or remove a listing if the Merchant Outlet fails to maintain expected presentation, safety, or service standards.

 

3. Airpartystay services

Airpartystay will use commercially reasonable efforts to generate inquiries through its outreach and marketing efforts and may support lead conversion through basic coordination assistance.

Operational updates

Changes relating to pricing, availability, or property details must be shared by email, SMS, or WhatsApp. Once received, Airpartystay will aim to implement updates within 10 working days.

Performance visibility

Where relevant to business planning, Airpartystay may provide periodic performance insights, campaign observations, or listing-related reports.

​

Airpartystay may also create tailored promotional packages or partnership plans based on the Merchant Outlet’s goals, audience, and business requirements.

 

4. Content and brand rights

Any images, videos, descriptions, logos, and other property material shared by the Merchant Outlet may be used by Airpartystay for listings, social media activity, and promotional advertising connected with the partnership.

Trademark ownership

The Merchant Outlet remains the owner of its trade name, logo, trademark, and overall brand identity.

Usage license

During the partnership, the Merchant Outlet grants Airpartystay a limited, non-exclusive, and non-transferable right to use approved brand assets strictly for listing and promotional purposes.​

• Airpartystay will use brand assets in approved formats and in a manner consistent with any brand guidance provided.

• Trademark usage will be limited to representation of the Merchant Outlet on Airpartystay platforms and campaign materials.

 

5. Commercial terms

All subscription fees, service fees, or onboarding payments made under this arrangement are non-refundable and will not be reversed once received.

Any additional service outside the agreed scope may be billed separately if both parties approve the commercial terms in advance.

Tansparency

Displayed prices must clearly match the actual price offered to the customer.

​

No Hidden Charges

Unexpected add-on fees must not be introduced after a customer engages through Airpartystay.

​

Mutual Extras

Custom campaigns, premium services, or add-on support may be priced separately by mutual agreement.

 

6. Suspension and termination

Either party may end the arrangement by giving 30 days’ written notice if a breach remains unresolved during that notice period, or if the other party becomes insolvent or discontinues operations.

The parties may also close the arrangement at any time by mutual written consent. Once termination takes effect, the rights and service obligations under the arrangement will stop immediately unless the parties agree otherwise in writing.

 

7. Liability and legal process

• The Merchant Outlet will indemnify and keep Airpartystay harmless against losses, damages, claims, disputes, and related costs arising from negligence, misconduct, misrepresentation, or breach by the Merchant Outlet.

• Airpartystay functions only as a listing and promotional platform and will not be responsible for guest disputes, property-level service issues, damage claims, or direct and indirect losses connected with the Merchant Outlet’s operations.

• Airpartystay accepts no responsibility for unlawful or criminal acts conducted at or through the Merchant Outlet.

• The Merchant Outlet confirms that all required approvals, registrations, licenses, and legal permissions for hosting guests are valid and in force, and that the property complies with applicable law and safety requirements.

 

Dispute pathway: The parties will first attempt settlement through discussion or mediation. If no resolution is reached, the matter will proceed to arbitration under the Arbitration and Conciliation Act, 1996, before a mutually appointed arbitrator, with Gurugram, Haryana as the governing jurisdiction.

 

8. Acceptance

By entering into this arrangement, the Merchant Outlet confirms that it has reviewed these terms, understood them, and agreed to be bound by them.
